EQUINE PARTIAL LEASE CONTRACT

This EQUINE PARTIAL LEASE CONTRACT is entered into on this

________________ day of ______________________month, in the year _______________,

by and between STACEY A. SHELEY (DBA) OPEN DOOR EQUINE INC. (OWNER)

and __________________________________________________________________________________________ (I and/or RIDER AKA LESSEE), and if the Rider AKA Lessee is a minor, the parent/guardian of Rider AKA Lessee.

WITNESSETH: STACEY A. SHELEY (DBA) OPEN DOOR EQUINE INC. (OWNER) does hereby partially lease to Lessee and Lessee does hereby lease from the Owner the

____________________________________(color) ____________________(gender) equine known as

_____________________________________________________________________________(equine’s name).

The lease shall be for a period of 12 months (twelve months), beginning the

_______________________(day) of __________________________ (month) ___________________(year).

In exchange for the partial use of the above named equine during the above stated period of this lease, the Lessee does hereby agree to the following:

  1. Lessee assumes agreed to proportion of responsibilities and to pay agreed to proportion of normal AND necessary expenses for the care of said equine consistent with the practices of good animal husbandry, including but not limited to; Lease fees, Lesson Fees, board, worming, veterinary expenses, hoof care, hauling and emergency veterinarian care. SEE APENDIX A
  2. Lessee warrants that he/she has inspected said equine and agrees to accept said horse in present condition.
  3. The title and ownership of the leased equine shall be and remain in the name of the Owner. Lessee shall NOT sell, mortgage or encumber this leased equine in any manner whatsoever. Lessee shall NOT assign this lease nor sublease the equine covered hereby.
  4. Lessee agrees that leased equine will NOT be used for breeding purposes.
  5. Lessee agrees to NOT remove the aforementioned leased equine from said equine’s boarded property unless it is a scheduled event such as an approved horse show or 4-H event.
  6. Lessee agrees to and has signed all required paperwork from equine’s boarded property regarding the use of boarded property including but not limited to: boarding properties rules, boarding properties release from liability contract and/or boarding properties termination regulations.
  7. Lessee is required to and is responsible for obtaining AGREEMENT AND RELEASE FROM LIABILITY CONTRACT from lessee’s; guests and/or relatives regarding any and all use of the leased equine and/or properties from Owner and/or stable where leased equine is boarded. If lessee does not obtain properly signed and dated required AGREEMENT AND RELEASE FROM LIABILITY CONTRACTS and remit said AGREEMENT AND RELEASE FROM LIABILITY CONTRACTS to Owner and/or stable where leased equine is boarded Lessee assumes FULL legal and financial responsibility for any and all actions of lessee’s guests and/or relatives upon immediate entry to and/or use of Owner’s equine and/or property and stable’s property.
  8. No less than 30 days notice is required from Lessee to terminate said lease once the lease is on a month to month basis.  Any notice to terminate said lease shall be in writing, dated and signed by both parties included in this lease. The 30 days notice to terminate said lease shall commence upon the dated and signed notice. Any and all monies paid forward upon termination of said lease shall remain the property of Owner.
  9. Monies paid forward by lessee is considered continuation of said lease and is included under this lease as agreement to fulfill lessee’s fiduciary responsibility to Owner for the partial use of said equine and is nonrefundable.
  10. Owner can end this lease at any time with or without notice requiring full remission of payment due upon evidence of neglect, abuse of said equine, abuse of Owner’s property, verbal and/or physical abuse of Owner; Owner’s employees, Owners other clients, Owner’s guests, Owner’s relatives, Owner’s other equines, of stable’s owners; it’s employees, guests, relatives, stable owner’s equines, livestock and/or pets, adjoining property; adjoining properties owners, their employees, guests, relatives.
  11. If this leased equine should at any time become missing, lost, seriously injured, sick or dead, the Lessee shall immediately notify Owner by telephone and subsequently by mail. If it is found that Lessee is responsible due to negligence, gross or otherwise for the loss, serious injury, sickness or death of said equine, Lessee will be held responsible to Owner for any and all financial loss occurring from the loss, serious injury, sickness or death of said equine including any and all legal fees associated with the loss of said equine.
  12. Owner shall NOT hold Lessee liable for any serious injury or death of the leased equine arising from events not resulting from negligence on the part of Lessee or the Lessee’s agents.
  13. Lessee shall hold Owner harmless for any injury to persons associated with lessee or damages to any and/or all property personal or otherwise of Lessee caused by the leased equine.
  14. Lessee, Lessee’s Family and Guests of the Lessee are expected to adhere to Stable’s Rules and conduct themselves in an appropriate manor per Rules and Guidelines at all times Lessee, Lessee’s Family and Guests of Lessee are on the stable grounds. These are posted throughout the stable area.

Open Door Equine Inc. does NOT lease it’s horses to non-current students. Any and all lease agreements and or contracts will be accompanied by riding lessons provided by Open Door Equine Inc. at the current going boarder’s rate. Riding lesson fees are NOT included in the leasing fees. ODE Inc. will lease it’s horses to past students who have shown proficiency in Horsemanship and Riding in a manor in adherence to the theories and beliefs of Open Door Equine Inc.’s philosophies and training methods.

No modification to this lease shall be binding unless in writing and executed by the parties hereto.

The undersigned Owner and Lessee accept these terms and conditions of this lease and acknowledge a copy thereof.
